Deputy IG Lagat Free to Resume Duties as Ojwang’ Death Probe Continues

Deputy Inspector General of Police Eliud Lagat is now free to return to duty after a court application barring him from accessing his office was withdrawn on Wednesday, July 2.

The application had sought conservatory orders amid ongoing investigations into the death of blogger and teacher Albert Ojwang in police custody.

High Court Judge Diana Kavedza allowed the withdrawal, stating the case had moved beyond the initial request. 

“The application is withdrawn as prayed. We will mention the matter on the 10th for directions on the main petition,” she said.

Ojwang died in early June following his arrest for allegedly posting defamatory statements about DIG Lagat. 

He was found with severe injuries while in custody and was pronounced dead shortly after, triggering public outcry and condemnation from rights groups.

In response to growing pressure, Lagat voluntarily stepped aside on June 16 to pave the way for investigations.

On Wednesday, his legal path to resume duties was cleared when the petitioner’s lawyer, Ndegwa Njiru, told the court they would seek to amend the main petition to reflect recent developments.

Inspector General of Police Douglas Kanja previously confirmed that Lagat had filed a formal complaint against Ojwang, which led to his arrest.

So far, six officers, including Central Police OCS Samson Talam and Officer Mukwana, have been charged with Ojwang’s murder. 

Investigations into the circumstances of the blogger's death are ongoing.

Ojwang’s family held a requiem mass on Wednesday ahead of his burial scheduled for Friday. 

His parents made emotional appeals for accountability, saying justice must be done to honour his memory.

The court will revisit the main petition on July 10 to determine the next steps.
